Last year a husband and wife, Jeffery Piccolo and Dr. Kankoporn Tangusan, were dining in a Disney Orlando park, and suddenly, tragedy struck when the wife had an allergic reaction to the food she was served while dining. This required her to be transmitted to a hospital where she would sadly meet her untimely death just a few hours later.
When Jeffery Piccolo and his wife, Dr. Kankoporn Tangusan were dining in Disney Orlando, the staff were advised not to serve Dr. Tangusan shellfish due to her severe allergy to it. However, when the husband and wife were served their food, Dr. Tangusan suffered a severe allergic reaction because she was served shellfish, despite the prior warning given to the staff.
Jeffery decided he would attempt to sue Disney for $50,000 over the death of his wife, but this would later cause issues, as Jeffery had signed a 30 day free trial for Disney +, which Disney claimed voided any ability for him to take Disney to court over the dispute. He had also purchased tickets from one of their services which they claimed essentially did the same thing as the 30 day free trial. This decision caused a tidal wave of criticism for Disney, and it was everywhere online.
After Disney received a large amount of criticism over the contract from all angles, they decided to drop that part completely and went to court with Piccolo to settle the dispute properly. However, no settlements have been made yet. Disney’s lawyers have made statements regarding the case and so has their chairman
My opinion on the subject is that Disney should not void any ability to take them to court simply because of a 30 day free trial, especially not in circumstances such as this, considering the sensitive nature of the case. I do think that it was a good decision to go to court with Piccolo, but I would say that at this point, it’s non-disputable to the general public that this is death is at the fault of Disney, and that’s what’s causing people to freak out about this, not only because someone is suing Disney which doesn’t happen often if ever, but the reason why they’re being sued is even crazier.
Putting the value of a free trial over a human life is insane! I know for a fact that almost no one is taking that much time out of their day to read the agreement, and even if they did, I’m sure they would think to find a clause about taking away any ability to sue them, but there isn’t much we can do but wait for the court adjournment. Another thing I will say about Disney is that the current chairman, Josh D’Aamaro, has made several statements on the subject matter that somewhat clear some of the air on the event.: “At Disney, we strive to put humanity over all other considerations,” he said. I think this statement at least has some element of truth, considering they were thoughtful enough to drop the contract. Hopefully Mr. Piccolo will get the justice he deserves for his wife.
